Resolute Forest Products and its wholly owned subsidiaries (“Resolute” or “we”) are committed to protecting the privacy of visitors of this website (“Website”). This Website Privacy Policy (“Policy”) explains how Resolute collects, uses and discloses the personal information you may provide while visiting this Website.

Our Website does not address anyone under the age of 14 (“child” or “children”). We do not knowingly collect personal information from children. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us. If we become aware that we have collected personal information from children without verification of parental consent, we take steps to remove that information from our servers.

Please note that this Website is also governed by Terms and Conditions. We urge you to consult the Terms and Conditions before proceeding further on this Website.

1. What information do we collect?

Anonymous browsing – You may visit this Website without telling us who you are or revealing any information about yourself, including your email address. In this case, our Web server may collect the IP address and domain you used to access this Website, the type and version of the browser and operating system you are using, and the website you came from and will visit next. This information is used by us and our business partners to measure the number of visits, average time spent, page views and other statistics about visitors to this Website in general. We may also use this data to monitor site performance for systems administration purposes to make this Website easier and more convenient to use, and to report information in aggregate form to our service providers (e.g., how many visitors access this Website).

Cookies – This Website may use “cookies,” a technology that installs information on a website user's computer to permit the website to recognize future visits using that computer. Cookies enhance the convenience and use of this Website. You may choose to decline cookies if your browser permits, but doing so may affect your use of this Website and your ability to access certain features of this Website.

Mobile device information – If you access this Website using a mobile device, we may collect information on your device and hardware ID’s device type, the request type, your carrier, your carrier’s user ID, the content of your request, and basic usage statistics about your device. This information is used by us and our business partners to measure the number of visits from mobile devices, average time spent, page views and other statistics about visitors to this Website in general. Use of Resolute products and services does not by itself identify you to Resolute though it may be unique or consist of or contain information that you consider personal. Information, including personal information, may be stored locally on the device using mechanisms such as browser web storage. Please consult your device or client documentation on how to manage such local storage. By default, your sending and our collection of such location information is set to “off” on our Website, but you will be informed about how to activate it. If you use location-enabled products and services, you may be sending us location information. This information may reveal your actual location, such as GPS data, or it may not, such as when you submit a partial address to look at a map of an area.

Your personal information – In general terms, privacy legislation defines personal information broadly as information about an “identifiable individual” or as information that allows an individual to be identified. During your use of this Website, you may choose to provide certain personal information to us, such as the information indicated in Section 2 below.

2. Why do we collect personal information and how do we use it?

As indicated above, it is always your choice whether or not to provide us with your personal information. Your consent may be express or implied, depending on the circumstances and the sensitivity of the information. Resolute uses your personal information obtained through this Website in accordance with current applicable privacy legislation and this Policy. Unless we otherwise obtain your consent, we will only use such personal information for the purpose of responding to your specific requests or needs, as specified below, or for support, to develop new features and to improve the overall quality of Resolute products and services.

Email alerts – If you choose to subscribe to our email alerts from this Website or from the company blog, you will need to provide your user email address (first name, last name and company are optional) in order to receive email alerts regarding Resolute news releases, SEC filings and/or stock quotes (from this Website) or newsletters (from the blog), as applicable. Your personal information will be used for that purpose. You can update your email address and other personal information or unsubscribe from our email alerts at any time via the Email Alerts section of this Website or the blog email alert. You can also email us at [email protected].

Career opportunities – Visitors using this Website may apply for job opportunities at Resolute via our Careers section. If you decide to do so, you will need to create an account, using your email address and a password, as well as a detailed online profile, including your employment history. If you apply for a job with us, you may also provide us with your resume/cv, cover letter, name, address, ZIP or postal code, phone number, work experience, years of experience, education information, willingness to relocate, language proficiency, how you heard about the position, professional memberships, certifications/licenses, work permit status, salary expectations, diversity information (indigenous or visible minority status, disability, and gender), and any additional information or documentation you choose to include in your application. We will only use such information for the purpose of analyzing your application and other related purposes, such as operationalizing our equal employment opportunity program.

Other requests – You may also voluntarily provide personal information (such as your contact information and a description of reasons for your contact) in order to request information regarding Resolute products or services or to contact our customer service department. If you do so, we will use your personal information to provide such information or to assist you, as applicable, and we may keep a record of your correspondence.

Please also note that we do not use your personal information for direct marketing or purposes unrelated to your communications with us, nor do we sell your personal information to third parties. Furthermore, email communications from Resolute to you will always include an identification of the sender and, if Resolute sends commercial electronic messages, these will contain an “unsubscribe” feature allowing you to opt out of such future messages, in compliance with applicable law.

3. To whom do we disclose your personal information?

For the purposes set forth in Section 2 above, we may disclose your personal information to the third parties indicated below in the following circumstances:

a) Disclosure to service providers

We may disclose your personal information on a need-to-know basis to other organizations or individuals that provide services on our behalf (“service providers”). Your personal information may be disclosed to the following categories of service providers: website service providers or consultants, lawyers, auditors, and data processing, document management and administrative services personnel. We will only provide such organizations and individuals with the information they need to deliver the service, and they are prohibited from using that information for any other purpose.

b) Disclosure in business transfers

Resolute may be involved in the sale or transfer of some of its business. As part of that sale or transfer, Resolute may disclose certain personal information about you to the acquiring organization (including as part of the due diligence process), but will require the acquiring organization to agree to protect the privacy of your personal information in a manner that is consistent with this Policy and applicable legal requirements.

c) Law enforcement and legal disclosure

Resolute may disclose your personal information to a government institution that has asserted its lawful authority to obtain the information or where Resolute has reasonable grounds to believe the information could be useful in the investigation of suspected unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and the disclosure of information, or to Resolute’s legal counsel.

d) To our affiliates

We may disclose your personal information to our affiliates, which include, in addition to our wholly owned subsidiaries, Domtar Corporation and its subsidiaries, which are part of the larger Paper Excellence Group.

4. Where do we keep or transfer your personal information?

Your personal information is stored in secured locations and on servers controlled by Resolute, located either at our offices or at the data centers of our service providers, which are located in Canada (including provinces or territories other than Quebec) and the United States. As such, your personal information could be transferred to and between those jurisdictions. When required by applicable law, we conduct privacy impact assessments to assess the risk associated with transferring personal information outside of Canada (or Quebec, as applicable). Please note that the privacy laws in other jurisdictions may differ from Canadian or Quebec privacy laws, and in some jurisdictions your personal information may be accessed by law enforcement authorities or the courts. If you have any questions regarding our policies and practices relating to storage and processing of personal information outside of Canada or Quebec, please contact us in any of the ways described under Section 9 below.

For access to your personal information, please see Section 9 below.

5. What are your rights regarding your personal information?

You have the following rights with respect to the personal information that we hold about you:

  • Subject to certain exceptions provided for by law, Resolute will inform you of the existence, use and disclosure of your personal information and will give you access to that information;
  • In certain circumstances provided by applicable law, you may ask that we delete certain personal information that we hold about you;
  • You may ask us to correct any personal information that we hold about you that is inaccurate, incomplete or equivocal, and some information stored in your user profile may be corrected directly by you if necessary; and
  • Subject to legal and contractual requirements, you may withdraw your consent to our use or disclosure of your personal information, but please note that such withdrawal may hinder our ability to offer you certain services, including access to this Website, or follow-up on your employment application.

If you are a user from Quebec, you also have the following rights with respect to the personal information that we hold about you:

  • In certain circumstances provided by applicable law, you may ask that we cease disseminating personal information about you, or de-index or re-index a hyperlink to which your personal information is attached; and
  • To the extent that doing so does not raise serious practical challenges for us, you may request that we communicate your personal information to you or to any person or body authorized by law to collect such information in a structured, commonly used technological format.

To exercise any of your rights described above, please send a request in writing to the Resolute email indicated in Section 9 below.

6. How do we protect your personal information?

We make commercially reasonable efforts to protect against the loss, misuse and unauthorized alteration of personal information under our control. Our IT security policies are periodically reviewed and enhanced as necessary. We instruct our employees with access to your personal information that it is to be used only in compliance with the principles set out in this Policy and applicable privacy laws.

We employ administrative, contractual and technological safeguards to protect your personal information. Where personal information is sent to a third party for processing, we make sure, through our contracts with them, that such service providers may only use the information for the limited purposes for which it was disclosed to them, and they are required to preserve the confidentiality of your information. Moreover, we operate secure data networks protected according to the sensitivity of the data in question.

Resolute only keeps personal information for as long as necessary and for the purposes for which it was collected, or for as long as required to comply with any applicable legal obligation. The length of time personal information is kept varies according to the nature of the information, and it may extend beyond the end of the relationship between an individual and Resolute. When the personal information collected is no longer required by Resolute, the necessary procedures for destroying, deleting, erasing or converting it into an anonymous form are applied. In some circumstances, we will anonymise your personal information (so that it can no longer be associated with you) for research or statistical purposes or other legitimate reasons, in which case we may use this information indefinitely without further notice to you.

7. Links to other sites

This Website may contain links to other sites that are not under the control or operation of Resolute. Resolute is not responsible for any content on any such site. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the privacy practices employed by other sites. As with our Website, you should become familiar with any external party's privacy policy when visiting such other site.

8. Changes to the Website Privacy Policy

Resolute reserves the right to modify or supplement this Policy at any time. If we make a change to this Policy, we will post the revised policy on this Website. IT IS YOUR RESPONSIBILITY TO CHECK THIS POLICY PERIODICALLY FOR CHANGES.
